Delta Toronto Crash: Flight Attendant Files Lawsuit Citing ‘Inexperienced Pilot’    ​

Fortunately, there were no fatalities, but the incident followed closely on the heels of the American Eagle mid-air collision in Washington, drawing attention to the safety of US regional aviation. Now, more than five months after the crash, an off-duty flight attendant who was on board the Delta Connection Bombardier CRJ900 is taking legal action against the airline, seeking millions in damages. The lawsuit claims that Delta endangered the passengers by assigning an inexperienced pilot and failing to provide adequate training.

Vanessa Miles, a 67-year-old flight attendant for Endeavor Air, was among the 80 passengers on Delta Air Lines Flight 4819, operated by Endeavor Air under Delta’s regional brand. She was on the flight to position herself for her next assignment, a practice known as ‘dead-heading.’ When the aircraft overturned upon landing in Toronto last February, Miles suffered serious injuries, including fractures and trauma, and has been unable to return to work since. She is now suing Delta for $75 million, although the airline has refrained from commenting on the ongoing litigation, stating its support for the Transportation Safety Board of Canada’s investigation.

Miles’ lawsuit against Delta Air Lines centers on her inability to work due to the injuries sustained in the crash. She alleges that the pilot was inexperienced and that Delta compromised safety by assigning such a pilot to the flight. Additionally, she claims the crew lacked proper training. Miles reportedly lost consciousness during the crash and awoke hanging by her seatbelt, surrounded by smoke and soaked in jet fuel. Her legal team argues that the incident was a result of negligence, accusing Delta of prioritizing profits over safety. This case highlights the critical importance of rigorous training and experience in aviation to ensure passenger and crew safety.
